the TAR for the Friuli Venezia Giulia, by order of collegiate
no.7 of 2011, filed on 1/13/2011, has raised
question of the constitutionality of 'art.
11 of Law 14 of 2007, the law allows, in the Friuli region
to extend the hunting exemption provided
only in special cases for birds, also
wild mammals.
The question of constitutionality was taken over by
League for the 'Abolition of Hunting
during an administrative procedure for cancellation of a regional
measure allowing the slaughter of 85 wild boars
in the Province of Pordenone. The LAC
, sponsored by 'Mr. Marchi Alessandra Forum
of Pordenone, showed that, by utilizing the' art. 11 of
LR 14/2007, the regional legislature has circumvented the restrictions imposed by
'art. 19 of Law 157/1992
(State framework law on the protection of wildlife) in order to
who can take any samples, including the general
hunting, except by state law,
for the execution of that activity. Basically
in Friuli Venezia Giulia, through that
law, and also thanks to further proceedings of the provinces
that incorporate regional measures, it has a hunting
in effect even during
closing at night and with the ' use of headlights (which is all
that usually are regarded as acts of poaching).

If it is true that, despite the postponement of the law to the Constitutional Court
, the law itself continues to explain
effect until the decision of the Court, it is also true that the League
for the 'Abolition of the Hunt is ready to challenge the
TAR, demanding the immediate suspension of the measures
killing of wild boars or other wild mammals
considered harmful, which measures should apply the law
suspected of illegality.

seriously suspicious of unconstitutionality, as
